The Registration Program is responsible
for FIFRA Section 3 Registrations, Section 18 Emergency Exemptions,
Section 24(c) Special Local Needs Registrations, 2(ee) recommendations,
and Experimental Use Permits. The registration process helps to
insure that all pesticides used in Arkansas have been tested for
safety and efficacy by the EPA before they are distributed within
the state.
Pesticide Registration
The
Arkansas
Pesticide Control Act of 1975
gives the Arkansas State
Plant Board (ASPB) the authority and responsibility to register
all pesticides distributed, sold, or offered for sale within the
State of Arkansas.
Pesticides are defined by the Arkansas
Pesticide Control Act as:
- Any substance or mixture of substances
intended for preventing, destroying, repelling, or mitigating
any pest;
- Any substance or mixture of substances
intended for use as a plant regulator, defoliant, or desiccant;
and
- Any substance or mixture of substances
intended to be used as a spray adjuvant;
Pesticides must be registered with
the State Plant Board before they are distributed,
sold, or offered for sale in Arkansas.
Registrants are responsible for any
unregistered product found within the State of Arkansas.
All registrations Expire on December
31.
Registration
Process
Registrants are to submit the following
items in order to register pesticide products in Arkansas;
- Completed Form DP-21 Application
for Registration of Pesticides in duplicate.
- One (1) copy of the product label
for each new product or revised label.
- A check for $200 per product
exempt from the Abandoned
Pesticide Disposal (APD) Fee, or a check for $250 for each
product not exempt from the APD Fee.
The ASPB does not require Material
Safety Data Sheets, EPA Stamped "Accepted" Labels, or
Confidential Statements of Formula unless specifically requested.
Please feel free to copy forms for
your use. If you wish to use a computer generated form, please copy
the original exactly. These forms and the information contained
on them are essential to our registration process. Please remember
to enclose two copies of each Pesticide Registration Form
you submit.
If you conduct registration activities
for multiple companies, please use a separate Pesticide Registration
Form for each company you register. Do not list multiple companies
on the same form.
The Arkansas State Plant Board only
requires new labels for new products or if changes have been made
to the label in the past year. It is not necessary to submit new
labels each year.
The Product Number column on the Pesticide
Registration Form is simply the Arkansas State Plant Boards
filing number. The first product registered is numbered 1 and each
additional product is numbered sequentially. This number is designed
to help us track the labels in our office.
Partial, incomplete, or
incorrect Pesticide Registration Forms will be returned to the registrant
for correction.
ALL REGISTRATIONS EXPIRE DECEMBER
31 OF EACH YEAR
